1. NON-DISCRIMINATION POLICY AND GENERAL CONDITIONS OF USE OF THE SITE

THE MASONSHOSPITALITY WEBSITE TERMS AND CONDITIONS OF USE ("GTU") AND TERMS AND CONDITIONS OF SALE ("GTS") INCLUDE A NON-DISCRIMINATION POLICY ("NDP") WHICH IS EXPLAINED BELOW:

These Site Terms of Use (the "Terms") constitute a legally binding agreement (the "Agreement") between you and MASONSHOSPITALITY (as defined below) that governs your access to and use of the MASONSHOSPITALITY site, including its subdomains and all other sites whereby MASONSHOSPITALITY provides the MASONSHOSPITALITY services (collectively, the "Site").

The terms "MASONSHOSPITALITY", "we", "us" or "our" as used in these Terms refer to LAGEDOWR SAS (MASONSHOSPITALITY) with whom you are contracting. Any dispute relating to the interpretation and execution of these Terms and Conditions of Sale and Use is subject to French law. In the absence of an amicable resolution, the dispute will be brought before the courts of Angers and in particular, the Commercial Court of Angers.

All payment services related to your use of the MASONSHOSPITALITY website (the "Payment Services") are provided to you by MANGOPAY (individually or collectively, as the case may be).

1.1 Our commitment to non-discrimination and respect

MASONSHOSPITALITY does not discriminate against or compete unfairly with sites that are accessible to non-Freemasons. Brothers and sisters who can become users and customers of this site must belong to a regular Masonic obedience accepted on the site (see list of accepted obediences on the site).

MASONSHOSPITALITY does not present or process any information related to the rituals practiced in Freemasonry. All the services offered on the MASONSHOSPITALITY website are available to the uninitiated in Freemasonry and are accessible on other websites.

MASONSHOSPITALITY is about a community limited to its members, which aims to bring together regular women and men Freemasons of the world by sharing enriching experiences and journeys with each other. Our community involves several million people from a number of countries around the world who belong to a masonic obedience accepted on the website. This community is characterised by a rich diversity as it brings together individuals from different cultures who share common masonic values.

MASONSHOSPITALITY permits third party bookings on the site through, under the control of and under the responsibility of a Brother or Sister who is a registered user of the site.

A third party may be a family member of a Brother or Sister or a close relative.

Our services can only be explicitly used by a registered Freemason user of the website.

Each Brother or Sister using the site agrees that the third party will respect our Privacy Policy and Non-Discrimination Policy and will respect the grounds for deactivation of an account, namely "non-consensual disclosure of a Brother's or Sister's Masonic membership or personal data by a site user or a third party" and "abuse of and non-compliance with the Terms and Conditions, including our Non-Discrimination Policy by a Brother or Sister site user or a third party". Each Brother or Sister user is responsible for the third party they represent on the site.

MASONSHOSPITALITY reserves the right to refuse to grant a request for a third party through a Brother or Sister and to deactivate the account of the third party if it is found to be abusive and contrary to our Privacy Policy and our Non-Discrimination Policy.

MASONSHOSPITALITY will not be responsible for any breach of our Privacy Policy and Non-Discrimination Policy and we will respond to your request to establish or enforce our rights in order to defend ourselves in a legal proceeding.

You may not create multiple accounts on the MASONSHOSPITALITY website unless authorized by MASONSHOSPITALITY. You may not assign or transfer in any way your MASONSHOSPITALITY account to another party. A third party, as defined above, may use the site only through the intermediary, control and under the responsibility of a Brother or Sister, Freemason user of the site and duly registered.

Tolerated and non-exhaustive examples of a third party request from a Brother or Sister that can be processed:

  • Request for accommodation for the child(ren) (third party) of a Brother or Sister who is a user of the site and who is going abroad for a university exchange or any other type of trip.
  • Request for accommodation and participation of the spouse or partner (third party) of a Brother/Sister at a St. John's Day party or any other event offered on our site and open to non Masons.
  • Request for the spouse or partner (third party) of a Brother/Sister to attend a meal organised in conjunction with an event or a trip offered on our site.

You are responsible for maintaining the confidentiality and security of your MASONSHOSPITALITY user account credentials and are prohibited from disclosing your credentials to any third party or any other party.

If you believe or have reason to believe that your credentials have been lost, stolen, misappropriated or otherwise compromised, or if there is any known or suspected unauthorized use of your MASONSHOSPITALITY account, you must notify MASONSHOSPITALITY immediately. You are responsible for all activities that occur under your MASONSHOSPITALITY account, unless you have not authorized such activities and are not otherwise negligent (e.g., by failing to report unauthorized use or loss of your credentials).

1.2. Membership of Freemasonry

The MASONSHOSPITALITY project was born out of the desire to bring together what is scattered, to strengthen the chain of union between initiates and to update the logistical links that existed for centuries.

MASONSHOSPITALITY submits access and use of the MASONSHOSPITALITY website to certain conditions or requirements, such as the submission to a verification procedure of membership in Freemasonry (see list of accepted obediences on the website).

MASONSHOSPITALITY reserves the right not to accept a Brother or Sister who is not a member of an accepted obedience on the site and who does not comply with our Privacy Policy and our Non-Discrimination Policy.

Before you can create your profile on our site, you must provide us with :

  • An identity document (photocopy of your identity card or photocopy of your passport). For the security of personal data, this document is verified by Mangopay and is not kept by MASONSHOSPITALITY.
  • A document proving your Masonic membership in an obedience accepted on the site (see list of accepted obediences). The document can be a Good Standing, a membership card with matriculation number or another official Masonic document.
  • A document (quitus/financial discharge) proving that you are up to date with your membership fees. For the good management of the site, these documents are stored for a maximum period of 3 years in accordance with the regulations.

Any transaction on the site is only possible on the initiative of a Brother or Sister duly registered on the site.

The identity of Freemasons registered on the site is protected in the following way: other members of the site see the first name followed by the initial of the last name before a transaction is validated on the site. Contact details are sent after the host has accepted the booking.

The photos of registered Freemasons can be modified as you wish, respecting the rules of common sense: no blurred photos or photos that have no connection with the subject.

We decline all responsibility for identity theft (if, for example, someone close to you uses your login and password without your knowledge) and we commit ourselves to deactivate the account of a person who has stolen the identity of a Brother or Sister. Legal action may be taken against anyone who has misused or attempted to misuse a Brother or Sister if any harm has been done.

Duly registered Freemason users are welcomed with authenticity, open-mindedness and respect for Masonic values. Joining MASONSHOSPITALITY as a user is a way to live our community and its values. Prejudice, bias, racism and hatred have no place on our site, nor in our community which shares humanistic and tolerant values.

Users, Brothers and Sisters, duly registered Freemasons, are required to respect all legislation in force prohibiting discrimination on the basis of religion, national origin, or other criteria listed below in (see 1.6. Specific instructions for site users).

1.3 Content on the Site

MASONSHOSPITALITY may permit users of the site, in their sole discretion, to create, upload, post, send, receive or store content, such as text, photos, audio or video content, or other materials and information on or through the site and to access and view content posted by members of the site and any content made available by MASONSHOSPITALITY on or through the MASONSHOSPITALITY site.

The MASONSHOSPITALITY website, MASONSHOSPITALITY content and content posted by users of the website may be protected in whole or in part by copyright, trademark and other laws of France and the countries in which users of the website are located. You acknowledge and agree that the MASONSHOSPITALITY website and the MASONSHOSPITALITY content, including all associated intellectual property rights, are the exclusive property of MASONSHOSPITALITY and/or its licensors or authorized third parties. You shall not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices contained in or accompanying the MASONSHOSPITALITY site, MASONSHOSPITALITY content, or content of user members of the site. The trademarks, service marks, logos, trade names and other proprietary designations used on or in connection with the MASONSHOSPITALITY site, the MASONSHOSPITALITY Content and/or the Collective Content are used for identification purposes only and may be the property of their respective owners.

You may not use, reproduce, adapt, modify, create "derivative works of", distribute, "license", sell, transfer, publicly display, transmit, broadcast or otherwise exploit the MASONSHOSPITALITY site or the Collective Content, except as may be expressly permitted by these Terms and Conditions or as you may be the beneficial owner of the content of relevant user members of the site. No license or right is granted to you by implication or otherwise under any intellectual property right owned or controlled by MASONSHOSPITALITY or its licensors, except for those licenses and rights expressly granted in these Terms.

By creating, uploading, posting, sending, receiving, storing or otherwise making available any content of user members of the site on or through the MASONSHOSPITALITY site, you grant MASONSHOSPITALITY a non-exclusive, worldwide, royalty-free, irrevocable, perpetual (or for the duration of the protection) license, transferable and sublicensable license to such Member Content to access, use, store, reproduce, modify, create derivative works from, distribute, publish, transmit, broadcast and otherwise exploit such Member Content for the purpose of providing and/or promoting the MASONSHOSPITALITY website in any medium. Except with your express consent, MASONSHOSPITALITY will not claim any ownership rights in any Member Content, and nothing in these Terms shall be deemed to limit your rights to use or exploit your Member Content.

MASONSHOSPITALITY may offer hosts the opportunity to use professional photographers to take pictures of their services offered by the host, which are made available to hosts for inclusion in their listings with or without a watermark or marking that includes the words "Photo verified by MASONSHOSPITALITY.com" or similar (the "Verified Images"). It is your responsibility to verify that your service as a host is accurately represented in the Verified Images and you must stop using the Verified Images on or through the website MASONSHOSPITALITY if they no longer accurately represent your listing, if you no longer provide the service offered by the featured host, or if your MASONSHOSPITALITY account is terminated or suspended for any reason. You acknowledge and agree that MASONSHOSPITALITY has the right to use any verified image for advertising, marketing and/or other commercial purposes in any medium, whether or not in connection with your listing, without notice to you and without compensation to you. If MASONSHOSPITALITY is not the exclusive owner of verified images, by using such verified images on or through the MASONSHOSPITALITY website, you grant MASONSHOSPITALITY an exclusive, worldwide, royalty-free, irrevocable, perpetual (or term of protection), transferable, and assignable license to use such verified images for any purpose, to use these verified images for advertising, marketing and/or other commercial purposes in any medium, whether in connection with your advertisement or not, without notice and without compensation to you. MASONSHOSPITALITY grants you a limited, non-exclusive, non-transferable, revocable and non-sublicensable license to use verified images outside of the MASONSHOSPITALITY website only for your personal, non-commercial use.

You are solely responsible for all Member Content that you make available on or through the MASONSHOSPITALITY website. Therefore, you represent and warrant that : you are either the sole and exclusive owner of all Member Content that you make available on or through the MASONSHOSPITALITY site, or you have all necessary rights, licenses, consents and permissions to grant MASONSHOSPITALITY the rights to such Member Content as provided in these Terms ; and neither the Member Content, nor your posting, uploading, publishing, submitting or transferring of the Member Content, nor MASONSHOSPITALITY's use of the Member Content (or any portion thereof) will infringe, misappropriate or violate any patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or publicity or privacy rights of any third party, or result in the violation of any applicable law or regulation.

You will not post, upload, publish, submit or transmit any Member Content that is fraudulent, false, misleading (directly or by omission or failure to update information), deceptive, defamatory, libelous, obscene, pornographic, vulgar or otherwise objectionable. You will not post, upload, publish, submit or transmit any Member Content that is fraudulent, incites discrimination, bigotry, racism, intolerance, hatred, harassment or otherwise causes harm to any individual or group. You shall not post, upload, publish, submit or transmit any Member Content that is violent, threatening or promotes violence or threatening acts against any person or animal, that encourages illegal or dangerous activities or substance use, or that violates the MASONSHOSPITALITY Terms and Conditions or any MASONSHOSPITALITY policy. MASONSHOSPITALITY may, without notice, remove or disable access to any Member Content that MASONSHOSPITALITY deems to be in violation of these MASONSHOSPITALITY Terms and Conditions or potentially harmful or unacceptable to MASONSHOSPITALITY, its Freemasons, other parties, third parties or property.

MASONSHOSPITALITY respects copyright laws and expects its members to do the same. If you believe that any content on the MASONSHOSPITALITY website violates your copyright, please notify us.

1.4. Modification of these Terms

MASONSHOSPITALITY reserves the right to modify these Terms at any time in accordance with this section. If we change these Terms, we will post the changed Terms on the MASONSHOSPITALITY website by changing the "Last Updated" date at the top of the Terms. We will also notify you of the changes by e-mail at least thirty (30) days before the effective date. If you do not agree with the amended Terms, you may terminate this Agreement with immediate effect. We will inform you of your right to terminate the Agreement in the notification email. If you do not terminate your Agreement before the effective date of the amended Terms and Conditions and you continue to access or use the MASONSHOSPITALITY website, you will be deemed to have accepted the amended Terms and Conditions.

The MASONSHOSPITALITY community is dedicated to building a world where Brothers and Sisters of all backgrounds and walks of life feel welcomed and cared for, no matter how far away they may come. This commitment is based on two fundamental principles that apply to users (both hosts and travelers) of MASONSHOSPITALITY : non-discrimination and respect. This commitment, shared by all, allows every member of our community to feel welcome on the MASONSHOSPITALITY website, regardless of rank or creed, origin, religious beliefs or political convictions.

We encourage our users to respect the national/local laws of the countries to which they may travel through our site and to act in a way that does not incur legal liability.

We hope that the MASONSHOSPITALITY community will strengthen the chain of union between Brothers and Sisters and encourage the sharing of the moral and symbolic wealth of Freemasonry.

We pledge to do our utmost to try to eliminate any type of discrimination or intolerance from our site. We are committed to promoting a culture within the MASONSHOSPITALITY community of Freemasons using the site that respects the principles of non-discrimination and the values of the Masonic Order in general. Accordingly, each MASONSHOSPITALITY associate, employee or partner agrees to read, abide by and act in accordance with our Privacy Policy and our Non-Discrimination Policy which follows.

1.5. Respect

Each user of the site is expected to show respect when interacting with other users. MASONSHOSPITALITY understands that laws and customs vary from country to country and region to region. Users of our site are expected to obey local laws and to relate respectfully to all people, including those whose views are contrary to their beliefs or education. MASONSHOSPITALITY members contribute to strengthening the chain of union and sharing experiences.

It is the responsibility of the hosts and travelers, users of MASONSHOSPITALITY, to identify, understand and comply with all laws, rules and regulations applicable to their advertisements and the services offered by them. Hosts are solely responsible for identifying and obtaining any necessary permits, licenses or registrations for the services offered by the Host. In many cities, hosts may be required to register, obtain a permit or licence before providing certain services offered by the host, such as preparing food, serving alcohol, offering a tour service or using a vehicle. Some types of services offered by the host are completely prohibited. Penalties may include fines or other enforcement measures.

  1. a. As the provider of the MASONSHOSPITALITY website, MASONSHOSPITALITY does not own, create, sell, resell, provide, control, manage or offer any advertisements or services offered by the Host. The hosts are solely responsible for their ads and services offered by the host. When members, users of the site, make or accept a reservation, they enter into a contract between them directly. MASONSHOSPITALITY is not and does not become a party to any contract between members, is not involved in the contractual relationship between members and is not a real estate broker or insurer. MASONSHOSPITALITY does not act as an agent for any member, except as provided in the Terms of Payment.
  2. While MASONSHOSPITALITY may facilitate the resolution of disputes, MASONSHOSPITALITY does not control or guarantee the existence, quality, safety, suitability or legality of any advertisement or host service, the truthfulness or accuracy of any advertisement description, rating, comment or other Member Content (as defined below), or the performance or conduct of any Member or third party. All references to a "verified" member mean that the member has undergone an appropriate verification or identification process. Such description does not constitute an endorsement, certification or guarantee by MASONSHOSPITALITY of any member, including their identity, background, reliability or trustworthiness. You should always exercise caution when deciding whether to stay in an accommodation, participate in an experience or event, or use other host services, accept a reservation request from a traveler, or have any other exchange or interaction with any other member, online or in person. Verified images, as defined below, are intended solely to provide a photographic representation of a listing as of the date the photograph was taken, and therefore do not constitute an endorsement by MASONSHOSPITALITY of any host or ad.
  3. If you choose to use the MASONSHOSPITALITY website as a host, your status with MASONSHOSPITALITY is limited to that of an independent contractor, and not an employee, agent, joint venture member or partner of MASONSHOSPITALITY for any purpose. You are acting exclusively on your own behalf and for your own benefit, and not on behalf of or for the benefit of MASONSHOSPITALITY. MASONSHOSPITALITY does not direct or control you, and shall not be deemed to direct or control you, either generally or pursuant to these Terms, including in connection with the provision of host services. You acknowledge and agree that you have full discretion to advertise your Host Services or otherwise engage in other business activities or employment.
  4. In order to promote the MASONSHOSPITALITY website and to increase the visibility of advertisements to potential travelers, advertisements and other forms of member content may be published on other websites, in applications and emails, and in online and offline advertisements. To assist members who speak another language, advertisements and other forms of member content may be translated, in whole or in part, into other languages. MASONSHOSPITALITY cannot guarantee the accuracy or quality of these translations and it is the responsibility of members to verify the accuracy of these translations.
  5. The MASONSHOSPITALITY website may contain links to other websites or "third party resources" (the "Third Party Services"). These "Third Party Services" may be subject to different terms of service and privacy practices. MASONSHOSPITALITY is not responsible for the availability or accuracy of such "Third Party Services" or the content, products or services available from such "Third Party Services". Links to such "Third Party Services" shall not be construed as an endorsement by MASONSHOSPITALITY of such "Third Party Services".
  6. Due to the nature of the Internet, MASONSHOSPITALITY cannot guarantee uninterrupted and continuous availability and accessibility of the MASONSHOSPITALITY website. MASONSHOSPITALITY may limit the availability of the MASONSHOSPITALITY website or certain areas or features of the MASONSHOSPITALITY website if necessary due to capacity constraints, to preserve the security or integrity of our servers, or to perform maintenance to ensure the proper functioning or improve the functioning of the MASONSHOSPITALITY website. MASONSHOSPITALITY may make improvements or changes to the MASONSHOSPITALITY website and add new MASONSHOSPITALITY services at any time.

1.6. Specific instructions for users of the website

In general, users should be aware of applicable federal, state, and local laws, particularly those pertaining to homes and public accommodations. Users are encouraged to contact us if they have any questions about their obligations to comply with this Non-Discrimination Policy. The MASONSHOSPITALITY user community in the European Union, the United States, and all other countries in the world shall comply with the following rules when considering travel, booking, and hosting as a host :

1.6.1. Skin colour, ethnic origin, national origin, religion, sexual orientation, gender identity or marital status

MASONSHOSPITALITY users are not allowed to;

  1. Refuse a user or third party introduced by a Sister or Brother user of the site because of their skin colour, ethnic origin, national origin, religion, sexual orientation, gender identity or family status.
  2. Impose any other selection criteria related to skin colour, ethnic origin, national origin, religion, sexual orientation, gender identity or family status.
  3. Publish an advertisement or make any statement containing any disincentive or preference criteria based on skin colour, ethnic origin, national origin, religion, sexual orientation, gender identity or marital status.

The criteria set out in relation to the sexual orientation or gender of a user (Freemasons) are also valid for a third party (e.g. a family member or close friend).

1.6.2. Gender

Users of MASONSHOSPITALITY are not allowed to

  1. Refuse to provide a service to a user of the site or to a third party because of his/her gender, unless the host has to share living quarters (e.g. toilet/bathroom, kitchen or common areas) with the traveler.
  2. Impose any other selection criteria related to gender, unless the host will be sharing living quarters with the traveler.
  3. Publish an advertisement or make any other statement containing gender disincentives or preferences, unless the host is to share living quarters with the traveler.

MASONSHOSPITALITY hosts may;

  1. Offer accommodation containing gender preferences if the host is required to share living quarters with the traveler.

1.6.3. Disability

MASONSHOSPITALITY hosts are not permitted to;

  1. Refuse a Brother, Sister or third party because of a real or perceived disability.
  2. Impose any other selection criteria related to a Brother's, Sister's or third party's disability.
  3. Judging, on behalf of a disabled Brother, Sister or third party who is to be potentially accommodated, whether accommodation meets their specific needs.
  4. Enquire about the existence or severity of a Brother's, Sister's or third party's disability, or about the means of accommodating a disability in an accommodation. However, if a Brother, Sister or third party discloses a disability, a host can and should assess, with the Brother, Sister or third party, the suitability of the accommodation for their specific needs.
  5. Prohibit or limit the use of equipment/vehicles for people with reduced mobility.
  6. Requiring higher rent or additional charges for a disabled Brother, Sister or third party.
  7. Publish an advertisement or make any statement which includes disincentives or preferences based on a disability of the Brother, Sister or third party.
  8. Refusing to communicate with travelers by so-called accessible means of communication, e.g. via a relay service (for the hearing impaired) or by e-mail (for the visually impaired using a screen reader).
  9. Refuse to offer reasonable accommodation or hospitality, including being flexible if a Brother, Sister or other disabled person asks you to deviate slightly from your house rules, for example by accepting a service dog which is essential to the traveler or by providing a parking space close to the accommodation. Where a Brother, Sister or third party makes such requests, the host and the Brother, Sister or third party will be expected to enter into a dialogue to find mutually agreeable solutions, ensuring that the accommodation meets the specific needs of the Brother, Sister or third party.

Users of the MASONSHOSPITALITY website shall;

  1. Provide accurate information about any accessibility facilities in the accommodation (or state that there are none), so that the disabled traveler is the sole judge of the suitability of the accommodation for his/her personal needs.

1.6.4. Personal preferences

MASONSHOSPITALITY users may;

  • Subject to the rules set forth above, MASONSHOSPITALITY users may refuse to rent to another user for reasons that are not legally objectionable. For example, unless prohibited by law, MASONSHOSPITALITY users may refuse travelers with pets or smokers.
  • Require users of the site to observe certain rules of life, such as dietary restrictions in the accommodation (e.g., in case of allergies).

Nothing in this policy prohibits a host from refusing a traveler for reasons that are not explicitly condemned by French law and by the local laws in force in the countries of use. For example, a MASONSHOSPITALITY host may refuse a traveler who wishes to smoke in an accommodation or may limit the number of travelers per accommodation.

Users of the MASONSHOSPITALITY website should endeavour to be welcoming to all Brothers, Sisters and others of all backgrounds and origins.

We ask users of the site (hosts and travelers) and third parties not to break the law and not to host travelers who might expose them to a proven risk of detention or damage to themselves or their property.

Hosts should indicate on the site whether there are any restrictions on their ability to accommodate certain travelers in their advertisements so that potential travelers are aware of them.

We ask hosts to communicate these restrictions in a clear and factual manner.

Insults and derogatory language have no place on our site or within our MASONSHOSPITALITY community. Any user who violates the rules of courtesy will have their account deactivated for "Abuse and non-compliance with the Terms and Conditions".

MASONSHOSPITALITY clearly states the financial percentage charged for each transaction made on the site. This percentage corresponds to the service fee and will vary depending on the services offered below.

In case of dispute, only the courts of Angers would be competent. Only French law is applicable.

ACCOMMODATION

2.1. General terms and conditions for accommodation

MASONSHOSPITALITY does not accept or encourage the improper subletting of accommodation in connection with unfair competition in the hotel trade.

MASONSHOSPITALITY does not accept or encourage the subletting and misleading renting of accommodation, which may cause problems with regard to the lack of accommodation in certain city centres.

MASONSHOSPITALITY encourages hospitality and fraternal help.

If you live or own a property in a municipality that has introduced rent control, certain rules may apply. Please contact your local council to find out what specific rules may apply to you.

You must check that the co-ownership regulations of your building allow the activity of renting accommodation.

If you are a tenant, you must have the agreement of your landlord to rent your accommodation on our site.

In general, it is not possible to sublet your accommodation in a social housing.

MASONSHOSPITALITY accepts bookings on the site, through the intermediary, control and responsibility of a Brother or Sister, Freemason, user of the site for a third party (member of his family or for a close relation).

Any reservation request on behalf of a third party must be explicitly validated and made by another user of the site, a Freemason.

Each Freemason user of the site undertakes to ensure that the third party respects our Confidentiality Policy and our Non-Discrimination Policy and respects the grounds for deactivation of an account, namely: "the non-consensual disclosure of a Brother/Sister’s Masonic membership or personal data by a user of the site or a third party" and "the abuse of and failure to comply with the General Terms and Conditions of Sale and Use, including our Non-Discrimination Policy, by a Brother/Sister who is a user of the site or a third party".

Each user Freemason is responsible for the third party he represents on the site.

A third party, as defined above, must be able to use the site only through the intermediary, control and responsibility of a Brother or Sister Freemason user of the site.

Tolerated and non-exhaustive examples of a third party request from a Brother or Sister that can be processed :

  • Request for accommodation for the child(ren) (third party) of a Brother or Sister user of the site going abroad for a university exchange or any other type of trip.
  • Request for accommodation and participation of the spouse/partner (third party) of a Brother/Sister at a St. John's Day party or any other event offered on our site and open to non Freemasons.
  • Request for the spouse/partner (third party) of a Brother/Sister to participate in a meal organised in conjunction with an event or a trip offered on our site.

MASONSHOSPITALITY collects and remits tourist tax in accordance with legal requirements.

MASONSHOSPITALITY reserves the right to refuse a booking request from a Brother or Sister or on behalf of a third party through a registered user of the site, and to deactivate the account of the latter if it is deemed abusive and contrary to our Privacy Policy and our Non-Discrimination Policy.

MASONSHOSPITALITY shall not be liable for any breach of our Privacy Policy and Non-Discrimination Policy.

2.2 Housing category

Hosts are responsible for identifying, understanding and complying with all laws, rules and regulations applicable to their Ads and Host Services. For example, some cities have enacted laws that prohibit hosting travelers for a fee for short periods of time, or providing certain Host Services. In many cities, Hosts may be required to register, obtain a permit or license before providing certain Host Services, such as preparing food, serving alcohol, providing a tour service or a vehicle. Hosts are responsible for identifying and obtaining any necessary permits, licences or registrations for the Host Services they offer. Some types of Host Services are completely prohibited. Penalties may include fines or other enforcement actions. If you have any questions about the local laws that apply to your Ads and Host Services on Masonshospitality, please contact a legal expert.

Main residence in France :

Under French law, your main residence is the place where you live for at least 8 months of the year, except in cases of professional obligation, health reasons or force majeure.

  • You can rent out your main residence entirely for a maximum of 120 days per year. (in application of articles L.324-1-1, R.324-1-2 and D.324-1 of the Tourism Code)
  • You can rent a room in your main residence for an unlimited period of time 365 days a year. (in application of articles L.324-1-1, R.324-1-2 and D.324-1 of the Tourism Code)

Secondary residence in France :

A secondary residence is a dwelling that you occupy for less than 4 months per year. This includes pied-à-terre or holiday homes.

In France, you can rent it out all year round as long as you have declared your rental activity to your local council. Some large cities may also require you to make a change of use beforehand.

There are 9 categories of accommodation in France subject to different tourist taxes:

The rental of a room in a private home, a second home, or one's main residence under the conditions provided for by French law, falls into the ninth category/nature of accommodation.

  2. 5 star tourist hotels, 5 star tourist residences, 5 star furnished tourist accommodation
  3. 4 star tourist hotels, 4 star tourist residences, 4 star furnished tourist accommodation
  4. 3 star tourist hotels, 3 star tourist residences, 3 star furnished tourist accommodation
  5. 2 star tourist hotels, 2 star tourist residences, 2 star furnished tourist accommodation, 4 and 5 star holiday villages
  6. 1-star tourist hotels, 1-star tourist residences, 1-star furnished tourist accommodation, 1, 2 and 3-star holiday villages, bed and breakfast establishments, collective inns
  7. Campsites and caravan parks classified as 3, 4 and 5 stars and any other outdoor accommodation of equivalent characteristics, pitches in camper parks and tourist car parks per 24 hour period
  8. Campsites and caravan parks classified as 1 and 2 stars and any other outdoor accommodation of equivalent characteristics, marinas
  9. Unclassified accommodation or accommodation awaiting classification

2.2.1. Registration and declaration requirements

What is the tourist tax?

Municipalities may require travelers staying in their area to pay a tourist tax. The amount of the tourist tax is freely determined by the municipality, within the limits set by law. An additional tax may also be introduced by the department (10%) or the region (for example, in France, the Ile-de-France region recently introduced an additional "Grand Paris" tax). These additional taxes are collected at the same time as the tourist tax and paid twice a year.

According to the laws in force in France, the remuneration received through the MASONSHOSPITALITY platform may be subject to tax and social security obligations. It is the responsibility of the owners or their representatives to submit all necessary declarations to the competent authorities. In this respect, please refer to the website of the tax authorities and the competent social organisations such as the public social security service.

Which accommodations are concerned by the tourist accommodation tax?

Non-residential accommodation in France :

Non-residential accommodation is dedicated to tourist accommodation.

The establishments subject to the tourist accommodation tax are

  • palaces
  • tourist hotels
  • tourist residences
  • holiday villages
  • guest rooms (in application of articles L.324-4, R.324-16 and D.324-15 of the Tourism Code)
  • outdoor accommodation (camping, caravan sites, etc.)
  • pitches in camping-cars areas and tourist car parks
  • marinas.

MASONSHOSPITALITY prefers to rent accommodation from local people. Generally, in France, you do not have to register your accommodation with the municipality:

  • If you rent out your main residence for less than 4 months per year.
  • If you rent out a room in your main residence (no annual booking limit).

If you rent out your second home, you must send a simple declaration to your local council.

If you live or own a property in a commune that has introduced rent control, certain rules may apply. Please contact your local council to find out what specific rules may apply to you in this respect.

MASONSHOSPITALITY collects and remits tourist tax in accordance with legal requirements.

2.2.2. Specific obligation to register in certain cities in France

The Law for a Digital Republic and the ELAN Law stipulate that certain municipalities may establish a "registration" procedure for anyone offering a furnished tourist accommodation (see definition above) for rent. This procedure is free of charge and only takes a few minutes. You need to obtain a registration number from the dedicated website set up by your town;

Once obtained, this number must be included in your advertisement. You must register your accommodation, if :

  • You rent out your main residence or your second home.
  • You are the owner or tenant of this accommodation.
  • You rent it out entirely (single room rentals do not require registration).

You do not need to register your accommodation, if :

  • This accommodation is a room in your main residence.
  • The accommodation is dedicated tourist accommodation, such as a bed and breakfast, guest house, hotel, serviced flat.
  • You rent the accommodation exclusively for a medium or long period, i.e. for periods longer than 3 consecutive months.
  • You rent this accommodation for a minimum period of 1 month to a tenant who can prove, on the date the lease takes effect, that he or she is in professional training, in higher education, on an apprenticeship contract, on an internship, on a voluntary commitment as part of a civic service, on a transfer or on a temporary assignment as part of his or her professional activity.

2.3. Service fees

  1. MASONSHOSPITALITY charges fees to travelers, the "Service Fees", in consideration for the use of the MASONSHOSPITALITY website. These fees may include any applicable taxes (legal additional tourists’ taxes).
  2. The applicable Service Fees are calculated as a percentage of the amount of the overnight stay decided by the host and paid by the traveler. They are charged by MASONSHOSPITALITY via MANGOPAY upon payment by the traveler. The payment of these fees is the sole source of revenue for MASONSHOSPITALITY. MASONSHOSPITALITY reserves the right to change the Service Fee at any time.
  3. You are responsible for paying the Service Fees due to MASONSHOSPITALITY. The applicable Service Fees are collected by MASONSHOSPITALITY via MANGOPAY. MASONSHOSPITALITY will deduct the service fees from the amount paid by the traveler before remitting the payment for the overnight stay to the host. Any traveler fees are included in the total fees collected by MASONSHOSPITALITY. Unless otherwise stated on the MASONSHOSPITALITY website, service fees are non-refundable (please refer to our payment policy).
  4. SPECIAL CONDITIONS FOR HOSTS

The terms "hosts" and "travelers" are applicable to all services offered on the MASONSHOSPITALITY website, involving the movement of our member users of the website and their third parties, under their responsibility.

3.1 Conditions applicable to all Ads

When you create an advertisement on MASONSHOSPITALITY, you must provide complete and accurate information (such as the description of the accommodation, its location and dates of availability). You must provide the relevant information requested by MASONSHOSPITALITY. It is your responsibility to keep your listing information (including availability dates) and account information current.

Any accommodation posted by you on the MASONSHOSPITALITY website must be owned by you and/or you must be explicitly authorised by law to rent it.

You are responsible for setting the price for your ad ("overnight stay price"). Once a traveler, a user of the site, has made a booking, you may not charge him or her a higher price than the price stated in your ad.

None of the conditions stated in your advertisement, including those relating to cancellations, must be contrary to these Terms and Conditions.

The photos, animations or videos (collectively, the "Images") used in your Ads must accurately reflect the quality and condition of your proposed services. MASONSHOSPITALITY reserves the right to impose a minimum and maximum number of images, in a specific format, size and resolution, for each Ad.

The placement and ranking of advertisements in the search results on MASONSHOSPITALITY may vary and depend on various factors, such as the search parameters and preferences of the traveler, the requirements of the host, prices and availability dates, the number and quality of images, customer service and cancellation history, the type of service offered by the host.

When you accept or have pre-approved a booking request from a Traveler, you enter into a legally binding agreement with that Traveler. You are obliged to provide the service(s) offered as a host to the Traveler in the manner described in your advertisement, as of the date of the booking request you have approved. You also agree to the payment of the MASONSHOSPITALITY website service fee, via MANGOPAY.

MASONSHOSPITALITY advises guests to take out appropriate insurance for their services as a guest. Please read your insurance policy carefully, and in particular, make sure you understand any exclusions from coverage under your insurance policy and any applicable deductibles, and check, among other things, whether your insurance policy covers the actions or omissions of travelers (and persons for whom the traveler has booked, as a third party, if applicable) during their stay in your accommodation or their participation in your experience, event or other service offered by the host.

3.2. Advertisements for Accommodation

You may only offer one accommodation per ad. You may, however, place multiple ads on our site.

You warrant that any ad you post and the booking of accommodation or the stay of a traveler in the accommodation will not violate any agreements you have entered into with other parties, such as council agreements, condominium bylaws or other agreements, and will comply with all applicable laws (such as planning laws), tax obligations and other rules and regulations (including obtaining any required permits, licences and registrations). As a host, you are responsible for your own actions and omissions and those of any person residing or present in the accommodation at your request or invitation.

3.3. Advertisements for Experiences, Events and other Services offered by the Host

Hosts who post advertisements for experiences, events and services offered by the Host other than accommodation agree to and abide by the additional terms and conditions described below.

You should carefully read the description of any experience, event or other service offered by the Host you intend to book to ensure that you (and other third party travelers for whom you are booking) meet the requirements specified by the Host in its advertisement, such as minimum age, abilities, accepted conditions. As a traveler and at your sole discretion, you may decide to inform the Host of any medical or physical condition or other circumstances that may prevent you or any additional (third party) traveler from safely participating in any experience, event or other service offered by the Host. In addition, certain laws, such as the legal drinking age in the country where the Host's experience, event or other service takes place, may also apply. It is your responsibility to identify, understand and comply with all laws, rules and regulations that apply to your participation in an experience, event or other service offered by the Host. Before and during a Host experience, event or other service, you must follow the Host's instructions.

You may not invite additional persons (third parties) to an experience, event or other host service unless you have added them as additional travelers (third parties) during the booking process on MASONSHOSPITALITY to enable the host to validate them.

3.4. Special conditions for Travelers

Subject to compliance with all the conditions set out by MASONSHOSPITALITY and/or the host (such as the verification procedure), you may book accommodation offered on the MASONSHOSPITALITY website by following the appropriate booking procedure.

The price displayed and paid by the traveler includes the accommodation costs, any applicable taxes and the operating costs (service fees) of the MASONSHOSPITALITY website.

The price is indicated before the reservation. The booking is at the initiative of the traveler and constitutes approval of the payment to be made for the price displayed.

All applicable fees, including the posted price, the traveler's fee and any applicable taxes (collectively, the "Total Fees") will be shown to you prior to payment.

You agree to pay the Total Charges for any reservation requested with your MASONSHOSPITALITY account.

3.4.1. Conditions applicable to all bookings

Upon receipt of a booking confirmation from MASONSHOSPITALITY, a legally binding agreement is established between the Traveller and the Host, in accordance with the payment terms.

If you book accommodation on behalf of additional travelers (third parties), you must check that the third party complies with the conditions set by the Host (no smoking, accommodation not suitable for young children, etc.). The third party must be informed by the Freemason member user of the site of the present conditions as well as other conditions, rules and restrictions defined by the Host and accept them. If you make a booking for an additional traveler (third party) who is a minor, you represent and warrant that you are legally authorised to act on behalf of the minor. In order to participate in any experience, event or other service offered by the Host, minors must be accompanied by an adult who is legally responsible for them.

3.4.2. Booking of Accommodation

You understand that a confirmed booking of accommodation (the "Accommodation Booking") constitutes a limited permission granted to you by the Host to enter, occupy and enjoy the accommodation for the duration of your stay, during which time the Host (subject to applicable law) retains the right to re-enter the accommodation in accordance with the agreement you have made with the Host.

You agree to leave the accommodation no later than the occupancy time specified by the host in the advertisement or a time mutually agreed between you and the host. If you stay beyond the occupancy time limit without the agreement of the host (the "Unduly Extended Stay"), you are no longer entitled to occupy the accommodation and the host is entitled to remove you from the accommodation by means that comply with the applicable law. In addition, you agree to pay, upon request of the Host, for each twenty-four (24) hour period (full or partial) of unduly extended stay, an additional fee. The Over-Stay Charge for late departures on the scheduled departure date that do not impact subsequent bookings may be limited to the additional costs incurred by the Host as a result of the Over-Stay. If you occupy the accommodation for longer than expected, you authorise MASONSHOSPITALITY (via MASONSHOSPITALITY) to charge you for the collection of the Overnight Stay Fee.

3.4.3 Booking changes, Cancellations and Refunds, Resolution Centre

Hosts and travelers are responsible for all booking changes they make on MASONSHOSPITALITY and agree to pay all posted prices, additional host or traveler (third party) charges and any applicable taxes and service fees associated with such bookings.

The host, on MASONSHOSPITALITY, must indicate when the accommodation of an ad is available or unavailable on the calendar of the ad. Details on availability can be provided as needed by message in the instant chat of the site or on the description of his/her ad that he can update as much as he/she wants.

Travelers may cancel a confirmed reservation at any time on the MASONHOSPITALITY website.

If the cancellation is made seven or more days prior to the scheduled arrival date, the traveler will be refunded the full amount of the overnight stay and the service fee charged, less one euro which will be retained by MASONSHOSPITALITY. This refund will be made by MANGOPAY in accordance with the cancellation policy.

If the cancellation is made within seven days or less of the scheduled arrival date, the traveler will be refunded 80% of the overnight stay fee. MASONSHOSPITALITY will retain the service fee collected up to a maximum of 10 euros. The host will be compensated by 20% of the overnight stay. This refund to the traveler and the payment to the host will be made by MANGOPAY in accordance with the cancellation policy.

These operations are described in detail in our Payment Policy.

For Host-provided experiences, events and other services, if inclement weather creates unsafe or uncomfortable conditions for travelers (force majeure), Hosts may modify or cancel a Host-provided service. In the event of a substantial change in the itinerary or if the Host's proposed service must be canceled, the Host must notify the traveler as soon as possible. If a Host cancels a confirmed reservation, the Traveler will be refunded the total fees paid for that reservation by MANGOPAY. The Host will not be entitled to any payment in this case.

In certain cases, e.g. in case of force majeure, obvious danger to the traveler in a country at war for instance, MASONSHOSPITALITY may decide, at its sole discretion, to cancel a confirmed reservation and make the appropriate refunds and payments via MANGOPAY.

3.5. Notations and Comments

MASONSHOSPITALITY does not provide any notations and comments system but reserves the right to set up such a system.

3.6. Damage to the accommodation, disputes between members and users of the site

  1. As a traveler, you are obliged to return the accommodation (including all personal effects or other goods found in the accommodation) in the state in which you found it on arrival. You are responsible for your own actions and omissions and those of any person you invite into the accommodation, or give access to the accommodation, excluding the host (and persons the host invites into the accommodation, if any).
  2. If a host alleges and provides evidence that you, as a traveler, have caused damage to an accommodation or to any personal effects or other property in an accommodation (the "Damage Complaint"), the host may request MASONSHOSPITALITY to delete your user account. For the proper management of the site, if you agree to compensate the host, please notify MASONSHOSPITALITY. MASONSHOSPITALITY shall not be liable for any such damages.
  3. If you are a traveler or host, you understand and agree to make a claim under your public liability or other insurance for any damage or loss you may have caused or for which you may be responsible to any accommodation, personal effects or other property.

3.7. Rounding

MANGOPAY supports the payment of amounts payable by travelers to hosts in the smallest unit supported by a given currency (Example: US cents, Euro cents or other supported currencies). For example, MANGOPAY can round up an amount of €101.50 to the nearest whole number €102 and round down an amount of €101.49 to the nearest whole number €101.

3.8. Taxes

According to the laws in force in your country, the remuneration received through the MASONSHOSPITALITY platform may be subject to tax and social security obligations. It is the responsibility of the hosts or their representatives to submit all necessary declarations to the competent authorities.

  1. The amount of your tourist tax, if any, is set by your city hall or local authorities. As a host, you determine a price per night which does not include the amount of this tourist tax. This tourist tax is calculated by MASONSHOSPITALITY, which collects it as part of its service fees and then remits it to the relevant authorities.
  2. Tax regulations via collection agencies may require you to collect relevant tax data about you as a guest and apply other taxes to you.
  3. You understand that any relevant government agency, department and/or authority (the "Tax Authority") responsible for the accommodation may require us to collect taxes from travelers and remit such taxes to the appropriate tax authority. Laws vary from country to country but these taxes may be collected and remitted as a percentage of the posted price set by hosts, a fixed amount per day, or other variations such as "tourist taxes", "hotel night taxes", "accommodation taxes", "municipal taxes", "room taxes" or "tourist taxes" (the "Occupancy Taxes").
  4. MASONSHOSPITALITY reserves the right, with prior notice to the guest, to introduce the collection / payment of compulsory taxes in any country where it is obliged to do so.

3.9. Prohibited activities

  1. You are solely responsible for complying with all laws, rules, regulations and tax requirements applicable to your use of the MASONSHOSPITALITY website. In connection with your use of the MASONSHOSPITALITY website, you will not assist or permit others to:
    1. Violate or circumvent any applicable laws or regulations, agreements with other parties, rights of other parties, or our terms, policies or standards;
    2. Use the MASONSHOSPITALITY site or the Collective Content for any commercial or other purpose not expressly permitted by these Terms, or in a manner that falsely implies an endorsement by MASONSHOSPITALITY, the existence of a partnership with MASONSHOSPITALITY, or otherwise misleads as to your relationship with MASONSHOSPITALITY;
    3. Reproduce, store, access or use in any way any information, including personal information about any other Member, available on the MASONSHOSPITALITY website, in contravention of the MASONSHOSPITALITY Privacy Policy or these Terms, or in violation of the privacy rights of any Member or third party ;
    4. Use the MASONSHOSPITALITY website to disseminate unwanted commercial messages (e.g. "spam") ;
    5. To offer, as a Host, an Accommodation which you do not own and which you are not authorised to offer for rent on the MASONSHOSPITALITY website ;
    6. Contact another member for any purpose other than to ask a question about your own booking, listing, or the member's use of the MASONSHOSPITALITY website, including, without limitation, recruiting or soliciting a member to participate in other services, applications, or websites without our prior written consent ;
    7. Use the MASONSHOSPITALITY website to request, make or accept a reservation outside of the MASONSHOSPITALITY website, in order to avoid Service Charges or for any other reason ;
    8. To request, accept or make payment of the posted price outside the MASONSHOSPITALITY website. If you do so, you acknowledge and agree that you are in breach of these Terms. You assume all risk and responsibility for such payment and release MASONSHOSPITALITY from any liability for such payment ;
    9. Discriminate against or harass any person because of their ethnic or national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation, or engage in any violent, dangerous, abusive or disruptive behavior ;
    10. Make any improper or abusive use of the MASONSHOSPITALITY services.
    11. Use, display or copy (including by "framing") the MASONSHOSPITALITY site or the collective content, or any individual item on the MASONSHOSPITALITY site, the MASONSHOSPITALITY name, any MASONSHOSPITALITY trademark, logo or other proprietary information, or the design or layout of any page or form appearing on any page of the MASONSHOSPITALITY site, without the express written consent of MASONSHOSPITALITY ;
    12. Dilute, tarnish or otherwise harm the MASONSHOSPITALITY brand in any way, including unauthorized use of the Collective Content, registration and/or use of the word MASONSHOSPITALITY or derivative terms in domain names, trade names, trademarks or other source identifiers, or registering and/or using domain names, trade names, trademarks or other source identifiers that closely mimic or are confusingly similar to MASONSHOSPITALITY domain names, trademarks, slogans, advertising campaigns or collective content ;
    13. Use any robot, spider, crawler, scraper or other automatic means or process to access the MASONSHOSPITALITY website, retrieve data or other content from the MASONSHOSPITALITY website or interact with the MASONSHOSPITALITY website for any other purpose ;
    14. Avoid, misappropriate, remove, disable, damage, decrypt, or otherwise attempt to circumvent any technological measures implemented by MASONSHOSPITALITY or any MASONSHOSPITALITY supplier or any other party to protect the MASONSHOSPITALITY website ;
    15. Attempt to decipher, decompile, disassemble or reverse engineer any software used to provide the MASONSHOSPITALITY website ;
    16. Take any action that disrupts or "interferes with" or could disrupt or interfere with the performance or proper functioning of the MASONSHOSPITALITY website ;
    17. Use, export, import or transfer our data without being permitted to do so by the laws of France, the export control laws of your country, and any other applicable laws ;
    18. Infringe on the rights of another party or harm anyone else.
  2. You acknowledge that MASONSHOSPITALITY has no obligation to monitor access to or use of the MASONSHOSPITALITY site by any user member of the site or any third party in the event of negligence (see our Non-Discrimination and Compliance Commitment), or to verify, disable "access to", or edit the Content of any user member of the site, but that MASONSHOSPITALITY has the right to do so in order to operate, protect and enhance the MASONSHOSPITALITY site (including, without limitation, for fraud prevention, risk assessment, survey and user support purposes).
  3. You acknowledge that MASONSHOSPITALITY may enforce compliance with these Terms by user members of the site; comply with applicable law, court order, or requests of the police, the judiciary, or other public agencies or organs of the French state; respond to user member content on the site that MASONSHOSPITALITY deems harmful or objectionable; or for other purposes as provided in these Terms. Member users of the site agree to cooperate with and assist MASONSHOSPITALITY in good faith, to provide MASONSHOSPITALITY with any information it requires and to take reasonable steps as requested by MASONSHOSPITALITY in connection with any investigation by MASONSHOSPITALITY or an agent of MASONSHOSPITALITY into the use or misuse of the MASONSHOSPITALITY website.
  4. If you believe that any member or third party with whom you interact, either online or in person, is engaging in or has engaged in any inappropriate behavior, including, without limitation, anyone who engages in offensive, violent or sexually inappropriate behavior, who you believe has stolen anything from you, or who is causing a disturbance in any way, you must immediately report such person to the appropriate authorities and then to MASONSHOSPITALITY, providing us with the contact information of the relevant police station and the police report number (if available). You agree that your report does not oblige us to take any action other than that provided by law (if any). MASONSHOSPITALITY may, where appropriate, delete the user account of any person(s) found to have engaged in such inappropriate behaviour.

3.10. Duration and Termination, Suspension and other Measures

  1. This Agreement shall continue in effect until terminated by either you or MASONSHOSPITALITY as described below.
  2. You may terminate this Agreement at any time by sending us an email and we will confirm receipt or you may deactivate your ad(s) and delete your user account by yourself using the features of the site. If you delete your MASONSHOSPITALITY account as a host, all confirmed bookings will be automatically canceled and your travelers will receive a full refund. If you delete your MASONSHOSPITALITY account as a traveler, all confirmed reservations will be automatically canceled and any refund will be subject to the cancellations conditions related to our payment policy.
  3. MASONSHOSPITALITY may immediately and without notice terminate this Agreement and/or cease to provide you with access to the MASONSHOSPITALITY website if you have committed a material breach of your obligations under these Terms and Conditions, the Payment Terms and Conditions, our Non-Discrimination Policy and the Respect Policy, if you have violated any applicable laws or regulations or the rights of others, or if MASONSHOSPITALITY believes in good faith that such action is reasonably necessary to protect the safety or property of MASONSHOSPITALITY, its Member users of the site, or third parties (Example: In the event of fraudulent conduct by a Member).
  4. MASONSHOSPITALITY may take any of the following actions to comply with applicable law, court order, or requests of law enforcement, judicial, or other public agencies or governmental bodies, or if you have violated these Terms, the Payment Terms, our Policies or Standards applicable laws and regulations or the rights of other parties, if you have provided inaccurate, fraudulent, outdated or incomplete information when creating the MASONSHOSPITALITY account, creating the ad or subsequently, you and/or your ads or Host services do not meet the quality or eligibility criteria at any time, or MASONSHOSPITALITY is otherwise informed or receives complaints about your performance or conduct, you have repeatedly canceled confirmed bookings or failed to respond to booking requests without legitimate reason, or MASONSHOSPITALITY believes in good faith that such action is reasonably necessary to protect the safety or property of MASONSHOSPITALITY, its Member users of the site or third parties, or to prevent fraud or other illegal activities :
    1. Refuse to post, delete or delay the publication of advertisements, or other content of members using the site;
    2. Cancel pending or confirmed reservations;
    3. Restrict your use of or access to the MASONSHOSPITALITY website;
    4. Suspend temporarily or permanently, in case of serious and/or repeated violations, your MASONSHOSPITALITY account and cease providing access to the MASONSHOSPITALITY website.
  5. In the case of minor violations and if necessary, you will be notified of any action MASONSHOSPITALITY is considering and given an opportunity to resolve the matter in a manner reasonably satisfactory to MASONSHOSPITALITY.
  6. f. If we take any of the actions described above against your user account, we may issue a full refund to travelers for your confirmed reservations. You will not be entitled to any compensation for outstanding or confirmed bookings that have been canceled in this connection.
  7. In the event of termination of this agreement, you are not entitled to a restoration of your MASONSHOSPITALITY account or your user member content data. If your access to or use of the MASONSHOSPITALITY website has been restricted, your MASONSHOSPITALITY account has been suspended, or this Agreement has been terminated by us, you will not be able to create a new MASONSHOSPITALITY account or access or use the MASONSHOSPITALITY website through another member's MASONSHOSPITALITY account.

3.11. Exclusions of liability

If you choose to use the MASONSHOSPITALITY site or the Collective Content, you do so voluntarily and at your own risk.

You acknowledge that you have had every opportunity to review the MASONSHOSPITALITY website services with respect to any laws, rules or regulations that may be applicable to your ads and/or the host services you offer.

You agree that certain travel / accommodation experiences and events, other services offered by the Host, may involve risks, and that by participating in these services, you voluntarily choose to assume these risks. For example, certain services offered by the Host and approved by you at the time of booking may involve risks of illness, injury, disability or death and you freely and voluntarily assume these risks by choosing to participate in such services offered by the Host.

You assume full responsibility for the choices you make before, during and after your participation in a service offered by the Host. If you bring a minor as an additional traveler (third party), you agree that you have the legal responsibility to do so, and you are solely responsible for the supervision of such minor during the Host-provided service, and to the fullest extent permitted by law, you agree to hold MASONSHOSPITALITY harmless from any and all liabilities and remedies related in any way, directly or indirectly, to any injury, death, loss, or damage suffered by such minor during the Host-provided service.

The above exclusions shall apply to the extent permitted by applicable law.

3.12. Liability

  1. You acknowledge and agree that, to the fullest extent permitted by law, you assume the entire risk associated with your access to and use of the MASONSHOSPITALITY site and the Collective Content, your posting of advertisements and bookings on the MASONSHOSPITALITY site, your stay in any accommodation, your participation in any experience or event, your use of any other services offered by the host, or any other interaction you have with other member users of the site, either in person or online.
  2. Neither MASONSHOSPITALITY nor any other party involved in creating, producing or delivering the MASONSHOSPITALITY site or the collective content shall be liable for any incidental, special, exemplary or consequential damages, including lost profits, lost data or goodwill, interruption of service, computer damage, system failure, cost of substitute goods or services, or any damages arising from any personal injury, personal injury or emotional distress arising directly or indirectly from these Terms, the use of or inability to use the MASONSHOSPITALITY site or the collective content, any communications interactions or meetings with other member users of the site or other third parties and persons with whom you communicate or interact or whom you meet in the course of your use of the MASONSHOSPITALITY site, or your posting of an advertisement or booking of accommodation which is the subject of an advertisement, including the provision or use of the Services offered by the host which is the subject of an advertisement, whether based on warranty, contract, harm (including negligence), product liability or any other legal theory, and regardless of whether MASONSHOSPITALITY has been advised of the possibility of such damages, even if any limited remedy set forth herein has failed of its essential purpose.
  3. Except for our obligation to pay amounts due to applicable hosts pursuant to these Terms or pursuant to a demand for payment approved by MASONSHOSPITALITY, MASONSHOSPITALITY's entire liability arising out of or relating to these Terms and your use of the MASONSHOSPITALITY website, including, without limitation, your posting of advertisements or booking of accommodations on the MASONSHOSPITALITY website, or the use of or inability to use the MASONSHOSPITALITY website or the Collective Content, and in connection with any accommodations, experiences, events, or other services offered by the Host, any interactions with other users of the site or third parties, shall in no event exceed the amounts paid or owed by you for bookings made on the MASONSHOSPITALITY site as a traveler in the twelve (12) months prior to the event giving rise to the liability or, if you are a guest, the amounts paid to you by MASONSHOSPITALITY in the twelve (12) months prior to the event giving rise to the liability, or the sum of one hundred Euros (€) (100 €), if no such payment has been made, as the case may be.
  4. The foregoing limitations of damages are fundamental elements of the agreement between MASONSHOSPITALITY and you. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. If you reside outside of France, the foregoing shall not apply to MASONSHOSPITALITY's liability for death or personal injury caused by your negligence, nor for misrepresentation, misrepresentation as to a fundamental matter, or any other liability which cannot be excluded or limited under applicable law.
  5. MASONSHOSPITALITY may be liable under certain provisions of law for intentional and gross negligence on the part of us, our legal representatives, directors or agents. This also applies to the assumption of guarantees or other objective liability or in the event of culpable injury to life, limb and/or health. Essential contractual obligations are obligations of MASONSHOSPITALITY which you expect to be fulfilled and on whose fulfillment you must be able to rely for the proper performance of the contract. The amount shall be limited to the foreseeable and current damage. Any other liability of MASONSHOSPITALITY is excluded.

3.13. General provisions

  1. These Terms and Conditions, together with any supplementary terms, policies, rules or standards supplementing them, constitute the entire agreement between MASONSHOSPITALITY and you with respect to the subject matter of these Terms and Conditions and supersede all prior agreements and understandings, whether oral or written, between MASONSHOSPITALITY and you with respect to your access to and use of the MASONSHOSPITALITY website
  2. No joint venture, employer-employee or principal-agent relationship exists between you and MASONSHOSPITALITY as a result of this Agreement or your use of the MASONSHOSPITALITY website.
  3. These Terms do not confer and are not intended to confer any rights or remedies upon any person other than the parties (Members, MASONSHOSPITALITY and third parties).
  4. If any provision of these terms and conditions is held to be invalid, void or unenforceable, such provision shall be struck out without affecting the validity and enforceability of the remaining provisions.
  5. MASONSHOSPITALITY's failure to exercise any right or provision of these terms and conditions shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing by us. Except as otherwise expressly provided in these terms and conditions, the exercise by either party of any remedy available to it under these terms and conditions shall be without prejudice to any other remedy available to it under these terms and conditions or at law.
  6. You may not assign, transfer or delegate this Agreement and your rights and obligations under these Terms without the prior written consent of MASONSHOSPITALITY. MASONSHOSPITALITY may, without limitation and in its sole discretion, assign, transfer or delegate this Agreement and its rights and obligations under these Terms upon 30 days' notice. Your right to terminate this agreement at any time remains unaffected.
  7. Unless otherwise specified, all notices or other communications to members using the site that are permitted or required by these Terms shall be made electronically and sent by MASONSHOSPITALITY by e-mail or by any notices on the site.

3.15.1. Overview

MASONSHOSPITALITY offers travel services in accordance with the rules and laws of the tourism industry.

MASONSHOSPITALITY accepts, through the intermediary, control and responsibility of a Brother or Sister Freemason user of the site, a travel reservation for a third party, as defined above.

Each registered Freemason user of the site agrees that the third party will comply with our Privacy Policy, our Non-Discrimination Policy and the reasons for deactivation of an account, namely:

"Non-disclosure of Masonic membership and non-disclosure of personal data" and "Abuse of and non-compliance with the Terms and Conditions of Sale and Use, including our Non-Discrimination Policy".

Each Freemason user is responsible for the third party they represent on the site.

A third party, as defined above, may use the site only through the intermediary, control and responsibility of a Brother or Sister Freemason user duly registered on the site.

MASONSHOSPITALITY reserves the right not to grant a request from a third party or relative through a Brother or Sister and to deactivate the account of such third party or relative if deemed abusive and contrary to our Privacy Policy and Non-Discrimination Policy.

MASONSHOSPITALITY shall not be liable for any breach of our Privacy Policy and Non-Discrimination Policy.

All Brothers, Sisters and third parties wishing to use the services of the MASONSHOSPITALITY website are included in the term "customer".

3.15.2 Force Majeure

MASONSHOSPITALITY shall not be liable for any failure to comply with these terms and conditions to the extent that such failure is due to a cause of force majeure, including without limitation fire, storm, explosion, flood or natural disaster, governmental decision, shortage of goods, strike, interruption of transport, accident or incident on the road, rail, air or sea, or bad weather conditions with regard to external events, as well as damage, failure or delay of one or more service providers, blockage of telecommunications, blockage of the Internet, etc.

In these cases, the client remains liable for the full payment of the service. Nevertheless, the client is free to take out "Operation Cancellation" insurance with the insurance company of his choice before the event, guaranteeing the financial losses and/or additional costs remaining to be borne by the insured, following one of the events mentioned in this article.

These Terms and Conditions shall be governed by and construed in accordance with French law and you submit to the exclusive jurisdiction of the courts of ANGERS (49000) FRANCE.
